2. Purpose

These Terms and Conditions govern the contractual relationship between CARRE Florian, hereinafter referred to as "the Seller", and any individual or legal entity, hereinafter referred to as "the Customer", wishing to purchase digital products offered for sale on the Gumroad platform.

The products offered are code templates (boilerplates) for web and mobile application development, under the commercial name "Craft".

3. Products and Services

3.1 Product Description

The Seller offers downloadable digital products:

  • Rapid Web - Next.js template for rapid MVP
  • Balanced Web - Production-ready template with 3-layer architecture
  • Crafted Web - Enterprise template with hexagonal architecture
  • Rapid Web + Mobile - Web and mobile template (React Native)
  • Balanced Web + Mobile - Production web and mobile template
  • Crafted Web + Mobile - Enterprise web and mobile template
  • Complete Bundle - All 6 templates

3.2 Features

Each product includes:

  • Complete source code (ZIP format)
  • Installation and usage documentation
  • MIT License for unlimited commercial use
  • 16 AI Skills for Claude Code
  • 10 pre-configured MCP servers
  • Email support
  • Lifetime free updates (sent via email)

4. Pricing

Prices are displayed in US dollars (USD) on the Gumroad platform:

  • Rapid Web: $139
  • Balanced Web: $149
  • Crafted Web: $159
  • Rapid Web + Mobile: $169
  • Balanced Web + Mobile: $179
  • Crafted Web + Mobile: $189
  • Complete Bundle: $199

Prices are displayed as final prices. VAT is not applicable under French tax law (Article 293 B of the General Tax Code - VAT exemption for small businesses).

The Seller reserves the right to modify prices at any time. Products are billed at the price in effect at the time of order validation.

Currency conversion (if applicable) is performed automatically by your bank or payment provider according to the exchange rate at the time of payment.

5. Ordering

5.1 Order Process

Orders are placed via the Gumroad platform (gumroad.com). The Customer selects the desired product(s), provides their email address, and proceeds to payment.

5.2 Order Validation

The order is considered final after:

  • Payment validation by Gumroad
  • Acceptance of these Terms and Conditions
  • Express waiver of withdrawal rights (for immediate download)

5.3 Order Confirmation

A confirmation email is automatically sent by Gumroad to the provided email address, containing:

  • Order summary
  • Payment receipt
  • Download link(s)

6. Payment

6.1 Payment Methods

Payment is made online via the secure Gumroad platform. Accepted payment methods are:

  • Credit/debit cards (Visa, Mastercard, American Express)
  • PayPal
  • Apple Pay
  • Google Pay

6.2 Payment Security

Transactions are secured by Gumroad via SSL protocol. The Seller does not have access to the Customer's banking information, which is processed exclusively by Gumroad and its PCI-DSS certified payment providers.

6.3 Invoicing

An invoice/receipt is automatically generated by Gumroad and sent via email to the Customer after payment validation.

7. Delivery

7.1 Delivery Method

Products are delivered digitally via instant download. The Customer receives an email containing the download link(s) within minutes of payment validation.

7.2 Download Availability

Download links are valid indefinitely via the Customer's Gumroad account. However, it is recommended to save downloaded files.

7.3 Delivery Fees

No delivery fees apply (digital delivery).

8. Returns and Refunds

8.1 Right of Withdrawal - Not Applicable

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to:

  • The supply of digital content not supplied on a tangible medium
  • When the performance has begun with the consumer's prior express consent
  • And after acknowledgment by the consumer that they will lose their right of withdrawal

Therefore, the 14-day withdrawal period mandated by European and French law does not apply to downloadable digital products.

8.2 Digital Goods - No Refunds

Due to the immediate digital nature of the products, all sales are final and non-refundable. Once the download link has been provided or the license key has been delivered, no refund will be issued. By completing the purchase, the Customer:

  • Expressly requests immediate delivery of digital content
  • Acknowledges being informed that they will lose their right of withdrawal
  • Expressly acknowledges and accepts the loss of withdrawal rights
  • Agrees that all sales are final and non-refundable

8.3 Technical Issues

If you experience technical issues with the product that cannot be resolved through our documentation and support, please contact us at contact@getcraft.dev. We will work with you to resolve any legitimate technical problems. However, this does not constitute a refund policy and all sales remain final.

9. Warranty and Liability

9.1 Product Warranty

Products conform to the descriptions provided on the sales page. The Seller warrants that products:

  • Are complete and functional
  • Match technical descriptions
  • Include all mentioned elements (code, documentation, license)

9.2 Technical Support

Email support is provided at contact@getcraft.dev for:

  • Installation questions
  • Technical issues related to the template
  • Documentation clarifications

Support does not cover:

  • Custom development or custom features
  • Issues resulting from code modifications by the Customer
  • Incompatibilities due to environments not meeting prerequisites

9.3 Limitation of Liability

Products are provided "as is". The Seller shall not be held liable for:

  • Indirect or incidental damages resulting from product use
  • Data or profit losses
  • Problems caused by code modifications
  • Product use in environments not meeting prerequisites

In any case, the Seller's liability is limited to the amount paid by the Customer for the product concerned.

10. Intellectual Property

10.1 MIT License

Each product is provided with an MIT License, which authorizes the Customer to:

  • Use the code for personal or commercial projects
  • Modify the code according to their needs
  • Distribute applications built with the code
  • Use the code for unlimited projects

10.2 Restrictions

The Customer is not authorized to:

  • Resell the raw or modified template as a template
  • Redistribute the template source code
  • Create derivative products intended to be sold as templates
  • Present themselves as the original author of the template

10.3 Trademarks and Logos

Trademarks, logos, and other distinctive signs reproduced on the site and in products are the property of the Seller or used with authorization. Any unauthorized reproduction or use is prohibited.

11. Personal Data

11.1 Data Collection

Personal data collected includes:

  • By Gumroad: Email, name (optional), payment information
  • By Seller: Email only (for support and updates)

11.2 Data Usage

Data is used for:

  • Delivery of purchased products
  • Technical support
  • Sending free product updates
  • License management and support

11.3 Data Rights (GDPR)

Under GDPR regulations, the Customer has rights of access, rectification, deletion, and portability of their personal data.

12. Dispute Resolution

12.1 Amicable Settlement

Before any legal action, the Customer is invited to contact the Seller by email (contact@getcraft.dev) to attempt an amicable resolution of the dispute.

12.2 Applicable Law and Jurisdiction

These Terms and Conditions are governed by French law. In case of dispute not resolved amicably, exclusive jurisdiction is attributed to the competent courts of Valenciennes, France, notwithstanding plurality of defendants or third-party claims.

13. Modifications

The Seller reserves the right to modify these Terms and Conditions at any time. Modifications take effect upon publication online.

The Terms and Conditions applicable are those in effect on the order date. Customers are advised to regularly consult the latest version available on this page.
